My Philosophy

My practice is limited to representing persons who have been injured at work, or by performing work activities over time, and who need to see a doctor or take time off work. Or, if you are the spouse of a dependent of a deceased worker who may have died as a result of work exposure or activities, please call me. I have a very small office.  I am the only attorney.  There is an office staff of one other person.  Your case will get direct attention.  I am unwilling to take your case if you already have a workers’ compensation attorney. 

Process

If you call my office we will ask you to provide medical or other records before scheduling an appointment.  Thereafter we will arrange a meeting.  During the meeting the particular issues presented by your case will be discussed.  Your rights and benefits will be explained to you.  A course of action will be proposed and outlined. 

Fees/Representation

There is no fee agreement in a worker’s compensation case.  The judge must set the fee at the end of the case.  The judge may award up to 15% of the recovery.  All fees are contingent.  No money will be requested of you directly. 

TIP:

If, after performing work activities, you believe you need to see a doctor or take time off work, ALWAYS report an injury to your employer/supervisor.  Ask for and complete the claim form which the employer MUST give to you by law (whether or not they feel the claim is valid!).  REJECT any offer from the employer “to take care of this myself outside of worker’s compensation.”  Such an offer is illegal and may affect your entitlement to benefits later!
            If your employer refuses to give you a claim form, immediately contact a worker’s compensation attorney or the Workers’ Compensation Appeals Board (State of California).
